Placing temporary staff creates a distinctive risk that standard professional indemnity doesn't automatically cover: being held responsible for mistakes, errors or injuries involving people who aren't your direct employees.
Vicarious liability is a specific extension that holds your agency responsible for the negligent acts of temporary workers while they're under a client's supervision — for example, a placed contractor who damages a client's system or equipment while on assignment. Standard professional indemnity typically only covers your agency's own errors, such as vetting mistakes, not the actions of the people you place.
Because employment status for temporary workers is often unclear, agencies can be treated as the legal employer for liability purposes — meaning you can be held responsible for a temp's negligence even though the client directed their day-to-day work.
If a placed worker is injured on assignment, your employers' liability policy needs to explicitly extend to cover temporary workers — this isn't automatic. Where the employment relationship is genuinely unclear, the agency, the hiring client and any umbrella company involved can all be brought into the same claim.
Vicarious liability needs to be confirmed under both your professional indemnity policy (for financial loss caused by a placed worker's error) and your public liability policy (for injury or property damage they cause). It's a genuine gap in many standard policies, not an automatic inclusion.
